1. Introduction and Acceptance

Welcome to AfriPrepLab! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and AfriPrepLab ("Company," "we," "our," or "us"), governing your access to and use of the AfriPrepLab website, mobile applications, AI tutoring services, and all related services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy.

Governing Law:

These Terms are governed by the laws of the Republic of Cameroon, without regard to conflict of law principles. For users in other jurisdictions, local consumer protection laws may also apply.

2. Eligibility and Account Registration

2.1 Age Requirements

  • You must be at least 13 years old to create an account and use our Services.
  • If you are between 13 and 18 years old, you must have permission from a parent or legal guardian to use our Services.
  • Parents or guardians who register accounts for children under 13 are responsible for supervising the child's use and ensuring compliance with these Terms.

2.2 Account Creation

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.
  • You may not create multiple accounts or share your account with others.

2.3 Account Types

Student Account
For learners preparing for exams and accessing educational content.
Tutor Account
For educators who provide tutoring services. Requires verification.
Institution Account
For schools and organizations managing multiple users.

3. Services Description

AfriPrepLab provides an AI-powered educational platform designed to help students prepare for various examinations including GCE, WAEC, NECO, JAMB, and other academic assessments. Our Services include:

  • AI Tutoring: Personalized learning assistance powered by artificial intelligence (Boni, our AI tutor)
  • Study Materials: Access to past papers, practice questions, study guides, and educational content
  • Interactive Quizzes: Self-assessment tools and practice tests
  • Progress Tracking: Analytics and performance monitoring
  • Community Features: Forums, study groups, and peer collaboration
  • Live Tutoring: Sessions with human tutors (premium feature)
  • Resource Library: Educational materials, flashcards, and concept maps

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with reasonable notice.

4. Subscription Plans and Payment

4.1 Free and Premium Plans

AfriPrepLab offers both free and premium subscription plans:

  • Free Plan: Limited access to basic features and content
  • Premium Plans: Full access to all features, content, and priority support
  • Institutional Plans: Custom plans for schools and organizations

4.2 Payment Terms

We accept payments through MTN Mobile Money and other approved payment methods. All prices are displayed in your local currency where available.

  • Subscription fees are billed in advance on a monthly or annual basis.
  • Automatic renewal will occur unless you cancel before the renewal date.
  • Price changes will be communicated at least 30 days in advance.
  • Taxes (VAT, GST) may apply based on your location.

4.3 Refund Policy

  • 7-Day Money-Back Guarantee: New subscribers may request a full refund within 7 days of initial purchase.
  • Pro-Rated Refunds: Annual subscribers who cancel after 7 days may receive a pro-rated refund for unused months.
  • No Refunds: Monthly subscriptions are non-refundable after the 7-day period.
  • Discretionary Refunds: We may provide refunds in exceptional circumstances at our sole discretion.

5. Acceptable Use Policy

You agree to use our Services responsibly and in compliance with all applicable laws. The following activities are strictly prohibited:

5.1 Prohibited Content

  • Posting or sharing illegal, harmful, threatening, abusive, or defamatory content
  • Uploading content that infringes intellectual property rights
  • Sharing sexually explicit or violent material
  • Posting spam, advertisements, or unsolicited promotions
  • Sharing personal information of others without consent

5.2 Prohibited Activities

  • Attempting to gain unauthorized access to our systems or other users' accounts
  • Using automated tools (bots, scrapers) to access our Services without permission
  • Engaging in academic dishonesty or helping others cheat on exams
  • Impersonating another person or entity
  • Interfering with or disrupting the integrity of our Services
  • Circumventing any security measures or access restrictions
  • Reverse engineering or decompiling our software

5.3 Academic Integrity

Important: AfriPrepLab is designed to enhance learning, not to facilitate cheating. Using our AI tutor or resources during actual examinations, or sharing exam content in violation of examination body rules, is strictly prohibited and may result in account termination and reporting to relevant authorities.

6. Intellectual Property Rights

6.1 Our Content

All content, features, and functionality of our Services—including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and AI models—are owned by AfriPrepLab or our licensors and are protected by international copyright, trademark, patent, and other intellectual property laws.

6.2 Your Content

You retain ownership of content you create and upload to AfriPrepLab ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of providing and improving our Services.

6.3 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial educational purposes.

6.4 Third-Party Content

Some content on our platform may be owned by third parties (e.g., examination bodies, publishers). Such content is used under license and remains the property of its respective owners. Past examination papers are provided for educational purposes under fair use provisions.

7. AI Services and Limitations

Our AI tutor "Boni" and other AI-powered features are designed to assist your learning. Please understand:

  • Educational Aid: AI responses are for educational guidance only and should not be relied upon as the sole source of information.
  • Accuracy: While we strive for accuracy, AI-generated content may contain errors. Always verify important information.
  • Not Professional Advice: AI responses do not constitute professional, legal, medical, or financial advice.
  • Continuous Improvement: AI features are continuously updated and may change over time.
  • Data Usage: Interactions with AI features may be analyzed to improve our Services, subject to our Privacy Policy.

8. Account Termination

8.1 Termination by You

You may close your account at any time through your account settings or by contacting us. Upon termination, you will lose access to your account and any associated data, subject to our data retention policies.

8.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms or our Acceptable Use Policy
  • We are required to do so by law
  • Your account has been inactive for an extended period
  • We reasonably believe your account poses a security risk
  • You engage in fraudulent or illegal activities

8.3 Effect of Termination

  • Your right to access and use our Services will immediately cease.
  • You remain responsible for any outstanding payments.
  • Sections of these Terms that by their nature should survive will remain in effect.

9. Disclaimers and Limitations of Liability

9.1 "As Is" Disclaimer

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 No Guarantee of Results

While we strive to provide high-quality educational resources, we do not guarantee that using our Services will result in passing examinations, achieving specific grades, or any particular academic outcome. Success depends on many factors including individual effort, prior knowledge, and examination conditions.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AFRIPREPLAB AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE OUR SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

10. Indemnification

You agree to defend, indemnify, and hold harmless AfriPrepLab and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you submit or share through our Services

11. Dispute Resolution

11.1 Informal Resolution

Before filing a formal legal claim, you agree to try to resolve the dispute informally by contacting us at legal@afripreplab.com. We'll try to resolve the dispute within 30 days.

11.2 Arbitration

If we cannot resolve the dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the arbitration rules of the relevant jurisdiction. The arbitration shall be conducted in Cameroon, unless another location is mutually agreed upon.

11.3 Class Action Waiver

You agree to resolve any dispute with us on an individual basis and waive your right to participate in a class action lawsuit or class-wide arbitration.

11.4 Exceptions

Either party may bring a lawsuit in court for: (a) intellectual property infringement claims, or (b) claims for injunctive relief.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and AfriPrepLab regarding our Services.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

12.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website with a new "Last Updated" date
  • Sending an email notification to your registered email address
  • Displaying a prominent notice on our platform

Your continued use of our Services after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using our Services.
